By accessing or using this website (the “Website”) or requesting/receiving pest-management services from Smithereen Pest Management Services (“Smithereen”, “we”, “us”, or “our”), you (“you” or “Customer”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not use the Website or request/receive our services.

1. Definitions

Company / We / Us / Our—Smithereen Pest Management Services, including its affiliates, subsidiaries, and agents.
Website—the website operated by Smithereen (e.g. smithereen.com) and any related online services.
Service(s)—pest management, extermination, or remediation services offered by Smithereen (residential, commercial, wildlife, etc.), and any related online requests/communications facilitated via the website.
User/Customer/You—an individual or legal entity using the Website and/or receiving services from Smithereen.

Scope of Services: We will specify in your service agreement what pests/treatments are covered (e.g., insects, rodents, wildlife, bed bugs), what is excluded, and whether the treatment is for indoor, outdoor, or both areas. Frequency of visits (one-time, monthly, quarterly, etc.) will also be defined.
Customer Responsibilities: You agree to provide accurate information about the property, grant access as needed, and follow any pre-treatment or post-treatment instructions we give (e.g., clearing areas, vacating premises, etc.). Failure to comply may void guarantees or service commitments.
Limitations/Exclusions: Some pests or structural conditions may be excluded. We reserve the right to refuse service or recommend alternative treatments if conditions are unsafe or outside the agreed-upon scope.

4. Payment Terms

Payment amounts (for base services, add-ons, emergency visits, etc.) will be clearly stated in your service agreement.
Payment is due as specified (e.g., before service, within 30 days of invoice, etc.). Late payments may incur fees or result in suspension of further services.
If you fail to pay, we reserve the right to deny future service until payment is made.

5. Disclaimers & Limitation of Liability

No Warranty: While we aim to provide effective pest-control services, results may vary depending on property condition, severity of infestation, and other factors beyond our control. We do not guarantee complete elimination of pests in all cases, unless explicitly stated in a service agreement.
Limitation of Liability: To the fullest extent permitted by law, Smithereen (and its affiliates, employees, agents) will not be liable for any indirect, incidental, special, punitive, or consequential damages — including loss of property, health, or other unexpected losses — arising out of or in connection with our services or use of the Website. This includes but is not limited to damages from pest recurrence, property damage, or third-party actions.
Indemnification: You agree to indemnify, defend, and hold Smithereen harmless from any claims, damages, liabilities, and expenses (including reasonable attorney’s fees) arising from your breach of these Terms or misuse of the Website or services.

6. Website-Specific Terms

We reserve the right to modify, suspend, or discontinue the Website (or any part of it) at any time without prior notice. Use of the website after modifications constitutes acceptance of the new terms.
